My husband and I both got laid off from our jobs within a few weeks of one another. We had a bit of a financial cushion built up in our savings account, but of course with no money coming in we quickly ran low on cash. At first we tried to keep up with all of our monthly payments and expenses, but as time passed and neither one of us was able to find new work, we started letting things slide. We simply had to prioritize our bills, and decide which were the most important to pay.
My loan payments to Charter One Bank didn’t seem like a priority, at least not in comparison to things like food, rent, and a certain credit card with truly outrageous interest. I still tried to pay a little bit each month on my loan, but I fell further and further behind. My husband managed to pick up a few odd jobs here and there, and whenever we had a few extra dollars I would put them towards the loan. I thought my diligence in at least attempting to pay a bit each month should count for something.

CBE Group brought my credit score down to a 501. I could not get a loan from the bank for a car, or a mortgage, it was chaos.
Unfortunately, the bank didn’t seem to understand that old saying: “you can’t get milk from a stone.” Even though my husband and I were out of work and had zero income, the bank still tried to get money out of us. They placed a $39 late fee and $39 over-limit fee on my account each month! Sometimes I thought they must actually want me to go broke and default on the loan.
All through this time, I kept thinking that if I could only get a job, everything would be okay again. Sadly, that wasn’t quite true. Charter One Bank sold my debt to CBE Group, and I started getting a steady stream of letters and phone calls from their debt collection agents. At first the representatives acted nice, but as it became clear that I simply couldn’t pay and had no intention of agreeing to any sort of payment plan until I had a new job, the CBE Group reps got more and more frustrated with me. They became very pushy, and stopped even pretending to listen to my side of the story. Our phone interactions became so unpleasant that I soon stopped answering the phone at all.
Not being able to pick up the phone when a strange number calls is a serious handicap in a job hunt! I needed to appear eager and available to potential employers, not distant and unreachable.

I received this deletion letter in the mail saying that CBE Group was no longer on my credit report, I almost jumped through my ceiling!!
As if the phone situation wasn’t enough punishment, CBE Group began adding fees and interest to my debt. Soon fees and interest made up about 30 percent of the balance! Plus, CBE Group started reporting my debt to the credit bureaus. I only found out about this because the credit bureaus are legally obligated to send you a notice each time an item is added to or removed from your credit history.
To make matters even worse, CBE Group reported the SAME debt to each credit bureau several times. At first this really upset me, but later on down the road this “mistake” by CBE Group turned out to be my ticket out of the whole situation.
My credit score bottomed out at 588. While my ultimate goal was still to get a new job, I realized that in order to recover financially, I had to change tactics and focus on my credit score first. Employers often run credit reports on potential hires, and I knew that my score was not reflecting well on me. I don’t know for a fact that I lost out on any job opportunities because of what CBE Group did to my credit, but I sure do know that they were not helping my chances!
Once I began researching debt collection law and credit repair services, I started to get a whole lot more hopeful about the entire situation. Here are a few of the things I learned:
-There is a statute of limitations regarding the collection of debts. It varies by state, but you should always check to make sure that the statute of limitations on your original debt has not run out BEFORE you make any payments to a debt collector.
-Creditors are responsible for proving that you owe them the amount they are trying to collect. You can initiate a process called debt validation in order to make them prove that you owe what they say you owe.
-You’re not powerless against debt collectors like CBE Group! Consumers are protected from unfair debt collection practices by the Fair Debt Collection Practices Act and the Fair Credit Reporting Act.
-Creditors are responsible for reporting accurate information to the credit bureaus. The credit bureaus don’t actually have any review process at all. When CBE Group reports a collection item to Experian, TransUnion, or Equifax, all the credit bureaus do is confirm with CBE Group that they received the information. They don’t actually verify the accuracy of the collection item with any other source. This explains how I got the SAME debt reported multiple times to all three bureaus.
Even after learning about my rights and potential methods I could use to fight back against CBE Group, I still wasn’t sure what the next step would be. I definitely didn’t feel confident enough to take on this project on my own, especially since it wasn’t just about CBE Group anymore. I would have to write to CBE Group, Experian, TransUnion, and Equifax to dispute the debt. I felt like I needed a professional.
